In general, the relationships between NYXIDIOM S.L. and the Users of its telematic services, as presented on this website, are subject to Spanish legislation and jurisdiction to which the parties expressly submit. The Courts and Tribunals are competent for the resolution of all disputes derived or related to its use.
Commercial communications via electronic means
Regarding the processing of data through websites for the realization of commercial communications via electronic means, the application of LSSICE (Law 34/2002, of July 11, on Information Society Services and Electronic Commerce) is imposed; it is collected in articles 19 to 22. This regulation is of great importance as it regulates the sending of electronic commercial communications, with the AEPD (Spanish Data Protection Agency) being the competent entity to sanction non-compliance.
The LSSICE generally prohibits the sending of advertising or promotional communications by email or other equivalent electronic means without having been previously requested or expressly authorized by the recipients.
Therefore, at the time of data collection, consent must be obtained with clear text informing users about the commercial purpose (as well as any other applicable purpose) for which the data will be used. It is advisable that your acceptance of the privacy policy be marked, and in the same way, you can indicate acceptance for the sending of commercial communications. This precept can be carried out by including on the website, at the time of requesting the data, two checkboxes of the style:
- I ACCEPT THE PRIVACY POLICY
- I ACCEPT THE SENDING OF COMMERCIAL COMMUNICATIONS
Pre-checked boxes cannot be included.
In any case, commercial communications must:
- Be clearly identifiable as such from the beginning of the communication, for example, by inserting the word “ADVERTISEMENT” or “AD” at the beginning of the email, in the case of SMS.
- Offer the user the ability to opt out of processing their data for promotional purposes through a simple and free procedure. For example, insert the following at the end of the email: “If you do not wish to receive more commercial communications, click here.”
- In the case of promotional offers that include discounts, prizes, gifts, or contests, the access or participation conditions must be clearly identified. It is recommended to insert the following clause at the end of the email: “Consult the conditions of the contest here” (and include the contest conditions in question).
- The consent for the use of personal data for advertising or commercial purposes must be revocable at any time through a simple and free medium. When communications have been sent by email, this communication must include a valid email address where you can exercise this right. Sending communications that do not include this address is prohibited.
Model clause to be included in commercial emails:
In accordance with the current regulations on the protection of personal data (Regulation (EU) 2016/679 of April 27, 2016 (GDPR), Organic Law 15/1999 of December 13 on the Protection of Personal Data, and Royal Decree 1720/2007, development of the LOPD), we inform you that the data contained in this communication is included in a data processing file owned by NYXIDIOM, S.L. This data will be used exclusively for sending communications that may be of interest to you. Your data will not be transferred to third parties, except by legal obligation, and will be kept until you request their cancellation or opposition. This commercial communication is sent under the protection of Law 34/2002, on Information Society Services and Electronic Commerce. If you wish to stop receiving commercial communications, revoke your consent, or exercise your rights of access, rectification, portability, opposition, limitation, or cancellation, you can request it at any time by sending an email to jordi.santamaria@nyxidiom.com indicating in the subject “Unsubscribe from commercial communications” or by communicating it in writing, always indicating your data to CARRER DEL LLORER, 36-38 08757 CORBERA DE LLOBREGAT (BARCELONA). If you believe that the processing of personal data does not comply with current regulations, you can file a complaint with the supervisory authority (www.agpd.es).
